Privacy Policy
This Privacy Policy describes how PINDOM LLC B ("Company," "we," "us") collects, uses, discloses, and protects personal information in connection with the Eightmate application and related services (the "Service"). By using the Service, you agree to the practices described here.
- We do not sell personal information to advertisers, data brokers, or any other party.
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Phone numbers, SMS consent status, and text-messaging originator opt-in data are not sold or traded, and are disclosed only to our SMS delivery provider, solely to deliver the messages you have requested.
- Your conversations are not used to train shared AI models. Content you submit is used to provide and personalize the Service for your account only.
- You can access and delete your information as described in the "Your rights and choices" section below.
1. Information we collect
- Account information: the name you provide, your phone number, your timezone, and account settings.
- Content: the messages, voice recordings (transcribed to text), and other material you submit to the Service, together with the responses generated for you and summaries of your conversations.
- Derived information: notes and inferences the Service records to personalize your experience, such as people you mention, preferences, reminders you schedule, and, where you have expressly enabled optional features, more detailed profiles derived from your conversations. Where a feature builds materially more detailed profiles, we ask for your separate consent when you enable it, and you can disable it at any time.
- Usage and technical information: log data, device and browser type, approximate performance metrics, and delivery status of messages. We do not use third-party advertising trackers in the app.
2. How we use information
We use personal information to: provide, personalize, and maintain the Service; deliver messages and notifications you have requested; process payments; provide customer support; monitor and improve reliability, safety, and security; enforce our Terms of Service; and comply with legal obligations. We do not use your content to train models made available to other customers.
3. How we share information
We disclose personal information only: (a) to service providers that process it on our behalf and under our instructions, currently Twilio, Inc. (text and voice delivery), Anthropic, PBC (AI model processing), Stripe, Inc. (payment processing), and Cloudflare, Inc. (hosting and content delivery); (b) when required by law, subpoena, or other legal process, or to protect the rights, safety, or property of the Company, our users, or others; and (c) in connection with a merger, acquisition, or sale of assets, in which case this Policy will continue to apply to previously collected information. Service providers are contractually prohibited from using your information for their own purposes.
4. Text messaging
SMS is optional and subject to separate opt-ins described in our SMS Policy. Consent to receive text messages is not a condition of using the Service. You may opt out at any time by replying STOP to any message or using the controls in the app, and you may reply HELP to any message for assistance. Message frequency varies; message and data rates may apply.
5. Data retention
We retain personal information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Upon verified account deletion, we delete personal information within thirty (30) days, except for limited records we are required to retain by law (for example, payment records) and residual copies in encrypted backups, which are overwritten on our standard backup rotation.
6. Security
Personal information is stored on infrastructure we operate, encrypted at rest, including backups. Access is restricted to authorized personnel of the Company. No method of transmission or storage is completely secure; we cannot guarantee absolute security, and you use the Service at your own risk to the extent permitted by law.
7. Your rights and choices
You may view and edit the memory entries the Service keeps about you in the app, and you may disable optional features at any time in settings. You may request access to, correction of, or deletion of your personal information by emailing [email protected] from the account being referenced; we will verify the request and respond within thirty (30) days. Residents of certain states (including California) may have additional rights under applicable law, including the right to know, delete, and correct personal information and the right not to receive discriminatory treatment for exercising those rights; we honor such requests as required. We do not sell or share personal information as those terms are defined in the California Consumer Privacy Act.
8. Children
The Service is intended for adults and is limited to users 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete it and terminate the associated account.
9. Changes to this Policy
We may update this Policy from time to time. Material changes will be noted here with a new "last updated" date, and where required by law we will provide additional notice or obtain consent. We will not materially weaken the commitments listed at the top of this Policy without obtaining your consent.
